I wonder if that would even be legal in California.

I wonder if commissions would encourage upselling any more than tips do?

Commission should be legal in California, I’ve seen it done in SF as well as LA!
Usually these restaurants already have an insanely high markup though

restaurants in Bacchus group (SF) as well as Jon and Vinny’s (Helen’s specifically) had commission on their wine sales. Helen’s markup was insane and their somms (depending on who) used to make bank back in the day, not sure about currently.
